What are the Types of Custody Granted in Nevada?

When going through a divorce, the custody of your children is one of the most important matters that will be settled. If you are approaching divorce or already in the midst of the process, it is imperative that you are aware of the types of custody and how these matters are decided in Nevada. First, there are two types of custody:

  1. Physical Custody
  2. Legal Custody

The first type, physical custody, grants a parent the rights to have the child live with them and be with them while the other parent may have visitation rights. The second type, legal custody, grants a parent the rights to make decisions on behalf of the child. The decisions could be regarding their medical care, their education, their religion, etc. These are the types of custody to be determined, but there are generally two methods of distributing the custody. These two methods are:

  1. Sole Custody
  2. Joint Custody

Sole custody means that one parent has complete responsibility of the child, either legally, physically or both. One parent can be granted sole physical custody and the non-custodial parent would generally pay child support to help the custodial parent with the financial needs of the child. One parent can also be granted sole legal custody of a child and they would then be responsible for all decisions of the child. More often than not, joint custody is ordered. Joint custody means that the parents share rights of the child, either legally, physically or both. Generally, the parents will split the responsibilities and share custodial time with the child and make legal decisions together.
