How a Revocable Living Trust Works

You create the trust during your lifetime and transfer your assets into it, a step known as funding the trust. During your lifetime, you serve as both the trustee, responsible for holding legal title and managing the assets, and the beneficiary, meaning the assets are held for your benefit. You retain the right to amend or revoke the trust in any way you choose as long as you are living and competent. At death, the trust becomes irrevocable and a successor trustee steps in to administer and distribute the assets as you directed, generally without court approval, disclosure, or oversight.

Funding the trust properly is critical. Titled assets such as real property, bank accounts, and investment accounts must be transferred into the trust during your lifetime for probate avoidance to work as intended. A revocable living trust doesn’t shield assets from creditors while you’re living, since you retain full control and benefit during that period. Revocable Living Trusts

Once established, an irrevocable trust generally can’t be changed. Assets placed in the trust are removed from your taxable estate and may be shielded from creditors, making this structure valuable for tax planning and long-term asset protection goals.

Nevada Self-Settled Spendthrift Trusts
Authorized under Nevada Revised Statutes Chapter 166, a self-settled spendthrift trust allows you to fund a trust for your own benefit while helping protect those assets from future creditors, subject to Nevada’s 2-year fraudulent transfer lookback period. Nevada’s statute is among the most favorable in the country for this structure.

Special Needs Trusts
Designed to provide financial support for a beneficiary with disabilities without disqualifying them from government benefits such as Medicaid and SSI. Careful drafting is important to support eligibility while still improving quality of life.

Testamentary Trusts
Created through a will and taking effect at death, testamentary trusts are often used for minor children or beneficiaries who benefit from managed distributions over time rather than a lump-sum inheritance.
