Gray divorce generally refers to ending a marriage later in life, often after spouses have spent decades building retirement savings, property, and shared financial arrangements. At Leavitt Law Firm, we provide personalized guidance through these interconnected decisions. Our family-owned law firm has served Las Vegas families since 1989.
Our founding attorney, Dennis Myron Leavitt, has practiced family law since 1989 and handled thousands of divorce cases. He works alongside Frank A. Leavitt and Benjamin J. Leavitt on decisions that can shape each spouse’s financial future following a decades-long marriage. Dividing Retirement Accounts, Pensions & QDROs
Retirement account division can be one of the most consequential parts of ending a long marriage. We handle property division involving:
- 401(k) accounts.
- Individual retirement accounts.
- Pensions.
- Military retirement benefits.
Each benefit must be reviewed under the rules governing that account or plan.
A Qualified Domestic Relations Order (QDRO) is a court order used to divide benefits held in a qualified retirement plan, such as a 401(k) or pension. A qualified plan administrator generally can’t distribute a share to the non-employee spouse without an approved QDRO. Using the proper order and transfer method can also prevent tax penalties when qualified retirement assets are divided.
Retirement division commonly requires:
- Identifying contributions and service earned while the spouses were married.
- Reviewing plan documents, account records, and beneficiary information.
- Preparing the QDRO or other order required for the specific benefit.
Nevada Revised Statutes section 125.155 governs the division of Nevada Public Employees’ Retirement System and Judicial Retirement Plan benefits. It uses a time rule based on employment during the marriage before the divorce decree. For these public benefits, the calculation excludes value attributable to post-divorce promotions or raises. Other accounts, including individual retirement accounts and military benefits, don’t necessarily use the same order or division method.
Classifying & Dividing Long-Held Nevada Assets
Nevada is a community property state. Property acquired by either spouse during the marriage is generally presumed to belong equally to both spouses, regardless of whose name appears on the title. Courts must, to the extent practicable, divide these assets equally unless a compelling reason for an unequal division is stated in writing.
Gifts and inheritances designated as separate property are excluded from that general presumption. Classification still depends on an asset’s history, including whether separate and marital funds were combined. The marital home, investment accounts, and other long-held assets therefore need to be classified and valued before division can be resolved.
Our high net worth divorce work may involve:
- Stock options.
- Trusts.
- Professional practices.
- Professional licenses associated with increased earning potential.
When financial asset valuation is complex, we work with forensic accountants and financial advisors. We also address business valuation and concerns about hidden assets.
