How Do I Get a Divorce in Las Vegas?
Nevada requires at least one spouse to have physically resided in the state for six weeks before filing for divorce under NRS 125.020. For an uncontested or collaborative divorce, you’ll need the following:
- Joint Petition Application — Request form that Las Vegas courts grant for divorce.
- Resident Witness Affidavit — Document for a third-party witness to confirm you’ve lived in Nevada for at least six weeks.
Individuals preparing for divorce must also address related matters, including child support, child custody, property division, visitation rights, and alimony.
A contested divorce is required when the parties can’t agree on issues such as custody, support, alimony, or visitation. Nevada recognizes different types of divorce, and we can assist in any of these areas.
You can still get divorced in Nevada even as a non-resident. The law requires at least one spouse to be a Nevada resident for six weeks before either party can file. As long as your spouse has satisfied the residency requirement, you can file for divorce in Las Vegas.
Is Nevada a No-Fault State for Divorce?
Yes. Under NRS 125.010, Nevada is a no-fault divorce state. Neither spouse is required to prove wrongdoing by the other. No-fault divorces are generally granted on the following grounds:
- Incompatibility; or
- Having been separated and living apart for a minimum of one year.
Uncontested vs. Contested Divorce in Nevada
One of the most consequential decisions you’ll make when dissolving your marriage is whether to file for a contested or uncontested divorce.
If you and your spouse agree on all divorce-related matters — how to divide property, handle child custody and support, and whether alimony is warranted — you can file for an uncontested divorce. In most uncontested cases, the parties negotiate terms directly or through an alternative dispute resolution (ADR) method such as mediation or collaborative law. Once an agreement is reached, both parties submit it to the court. If a judge finds the agreement equitable, it’s signed, and the divorce is finalized.
When the parties disagree on any material issue, a contested divorce is required. That process may involve trial and can take a year or longer in complex cases, with each party presenting their position before a judge in the Eighth Judicial District Court Family Division.
